SPECIAL BANKRUPTCY UPDATE #2
[03.31.08] -- Today, at a little after 3:00 pm Honolulu time, the bankruptcy court adjourned after Judge Lloyd King informed the parties that it was not necessary, in his opinion, for Aloha to obtain approval from the court before making the decision to shut down its operations. Rob Clayman, AFA’s Outside Counsel, whom you may remember from the first Aloha bankruptcy, made an excellent and impassioned argument on behalf of AFA and the Aloha flight attendants in opposition to the Company's shutdown plan, but the court refused to be swayed from its position. No other unions rose through their attorneys to oppose the shutdown.
With the court refusing to take any role in the matter of the Company's shutdown, management's plan to cease operations tonight appears to have carried the day. We made every effort to pursue a legal strategy that would prevent or forestall the shutdown. I regret that nothing we could do was able, in the end, to prevent this tragic loss of a venerable airline, and it proved impossible to preserve the jobs of the wonderful Aloha Flight Attendants.
AFA will continue to represent the flight attendants, and to participate in the deliberations of the Creditors' Committee. It's not impossible -- although it's highly unlikely -- that some investor could step in to revive the Aloha brand and the Aloha certificate following the shutdown. If such an opportunity presents itself, AFA will make every effort to assist in the revival of this airline and help our members reclaim their jobs.
