This is being filed as a formal Scheduling Complaint.
Document 6.3.g. (Document 41, page 4) states that “these (rescheduling/reassignment) provisions are intended to allow for orderly rescheduling procedures in the event of last minute operational irregularities that have a high probability of resulting in trip delay or cancellation. These provisions are not intended to be utilized in such a manner as to effectively require a Bid Flight Attendant to serve as a reserve.”
On October 12, 2007, Scheduling called the 72OB crew (Bortfeld, Ikeda, Yogi) informing them that their flight #474 on Oct. 13 was cancelled, and were to report for a 1400 deadhead on flight #442. The crew would then resume their normal bid assignment on Oct. 14.
On Oct, 13 at 9 a.m., Scheduling called the 72OB crew and told them to report for a 1335 ferry flight from HNL – KOA and then to work another bid crews flight #478 KOA – OAK. In reality, there was no ferry flight and the crew had 29 passengers from HNL – KOA. This additional rescheduling was not legal and should have been assigned to a Reserve crew especially since their original bid award, flight #474 ran as scheduled with the 71HB crew (Adams, Chock, and DeFries).
The remedy sought is to pay the two aforementioned crews their bid guarantee on Oct. 13 on top of their pay time for that day. Furthermore, a trip off of choice for the two crews, with full pay and credit including per diem. If the trip off of choice falls on a holiday, the provisions of Section 15.M. shall also apply.
